Terms of Service

The short version

This is a fan-driven road-trip site operated by KFLO Entertainment, Inc. ("KFLOE," "we," "us"), publisher of Tediddle. Submit fun challenges, keep it legal, and accept that everything is provided as-is. Using the site means you agree to these terms.

Your account

  • You must be at least 16 years old.
  • One account per human. Don't impersonate anyone.
  • We can suspend or remove accounts for abuse.

User-submitted content

You keep ownership of what you submit. By submitting, you grant KFLOE, its affiliates, and licensees a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, edit, publish, distribute, and display your submission in any medium, for any purpose (commercial or otherwise), now or in the future, without attribution or further consent. Mission Control may edit, reject, or feature any submission.

Keep it legal and kind

No harassment, no doxxing, and no content that encourages illegal, dangerous, or trespassing behavior. Challenges must be performable without breaking laws or endangering anyone.

Don't submit copyrighted material you don't have rights to. You're responsible for clearing any rights you need before you submit.

Trespass and on-the-road safety

Submissions must be performable from public spaces or with explicit permission of the property owner. The Released Parties (KFLOE, its affiliates, officers, employees, agents, the road-trip participants, and any guests or passengers riding with them) are not responsible for any in-person activity arising from the road trip or anything posted on the site. Cross fences, ignore signs, or pick fights with strangers at your own risk and at no one else's.

No warranty

The site and any on-the-road activity are provided "AS IS" and "AS AVAILABLE" with no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no guarantees that the site will be accurate, complete, secure, uninterrupted, or available. Any reliance on challenges, locations, or information on the site is at your own risk.

No Released Party makes any warranty regarding any aspect of the Summer Meet-Up activities or anything posted on the site.

Limitation of liability

To the maximum extent allowed by law, the Released Parties are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or loss of goodwill — arising from your use of the site or any in-person activity connected to it, even if we've been advised that such damages are possible.

Our total aggregate liability to you for any claim is capped at $0 (zero U.S. dollars). Some jurisdictions don't allow some of these exclusions or limitations; in those jurisdictions, the limitations apply only to the extent permitted.

Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content, (b) your use of the site, (c) your violation of these terms, or (d) your violation of any rights of any third party.

DMCA / copyright complaints

If you believe content on the site infringes your copyright, email a notice to help@tediddle.com with the subject line "DMCA Notice." Include:

  • Identification of the copyrighted work claimed to be infringed.
  • The URL of the allegedly infringing content on the site.
  • Your name, mailing address, phone number, and email.
  • A statement, under penalty of perjury, that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law, and that the information in the notice is accurate.
  • Your physical or electronic signature.

We respond to valid DMCA notices by removing the content and notifying the user who posted it. If you receive a takedown notice you believe is mistaken, you may submit a counter-notice to the same address.

We terminate accounts of users we determine to be repeat infringers.

Termination

We may suspend or terminate your access to the site at any time, with or without notice, for any reason — including but not limited to violations of these terms.

Sections that by their nature should survive termination (User-submitted content license, No warranty, Limitation of liability, Indemnification, Governing law and disputes) survive.

Marketing emails

By providing your email address, you agree to receive occasional marketing emails from Tediddle and xlightshows.io about products, road-trip updates, and xlightshows.io events and merchandise. You can unsubscribe anytime via the link in any email or by emailing help@tediddle.com. Per CAN-SPAM, our marketing emails include our mailing address and a one-click unsubscribe.

Governing law and disputes

These terms, and any future agreements you enter into with KFLOE, are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. For any matter not subject to arbitration below, you agree to submit to the personal and exclusive jurisdiction of the courts located within the city of Peoria, Illinois, USA.

Informal resolution first. Before either side starts arbitration, you and KFLOE agree to attempt to resolve any dispute informally for at least 30 days via email at help@tediddle.com.

Binding arbitration. Any dispute or claim relating in any way to your use of the site (each, a "Claim") will be resolved by binding arbitration through JAMS, rather than in court. Arbitration will be seated in Peoria, Illinois and conducted under JAMS's then-current consumer arbitration rules; remote or telephonic proceedings are permitted by mutual agreement.

Class-action waiver. There is no right or authority for any dispute to be arbitrated on a class action basis or to utilize class action procedures. There is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. You and KFLOE also waive any right to a jury trial on any Claim that proceeds in court.

Carveouts. Either side may bring an individual action in small-claims court or seek injunctive relief in court to protect intellectual-property rights. Those actions are not subject to the arbitration requirement above.

Severability and entire agreement

If any clause of these terms is found unenforceable, the rest stay in force. These terms together with the Privacy Policy are the entire agreement between you and KFLOE with respect to the site, and supersede any prior agreements.

Changes to these terms

We may update these terms over time. The effective date at the top reflects the current version. Continued use of the site after an update means you accept the revised version.
